Service Usage Terms and Conditions

AS Modelmax (further "Administration") offers to sign the Agreement on below stated conditions with physical person (further “User”) agreed with current Agreement conditions. .

1.1. Accepting current Agreement conditions, User expresses agreement with all conditions of the Agreement. All current Agreement conditions acceptance by the User is obligatory for using “Dark Swords” game (further “Game”).

1.2 Administration engages oneself to provide access of the User to the Game at no extra charge. User pays him self for the access to the internet. Administration provides User with extra chargeable service. Conditions are covered in current Agreement or its Appendixes. Order and conditions of providing extra chargeable service are covered in section 5 of the current Agreement.

1.3. Description of the Game and its rules covered in “Game rules” part of the web-site darkswords.eu, are considered to a part of the current Agreement and are obligatory to execute for the User.

1.4. User of the Game is any person having access to the Game in accordance with the current Agreement who is using materials covered on the web-site darkswords.eu,only for personal purpose.

1.5. “Materials” and “Components” are considered to by any text, visual information, images, graphics and any other data in visual, audio or audiovisual or any other format covered on the darkswords.eu. web-site. This term also means any materials covered on any web-site or web-page having link to darkswords.eu.

2.1. In accordance with the current Agreement conditions Administration allows User to use "Dark Swords" Game in accordance with game rules on a twenty-four hour basis except for time needed for preventive measures and other circumstances preventing from access to the Game appeared not by Administration fault.

2.2. User engages oneself to observe conditions of the current Agreement.

2.3. From the moment of conditions acceptance by the User he is applied by all conditions of the current Agreement.

2.4. In case of violation of the current Agreement by User Administration keeps the right to forbid further usage of the Game.

2.5. Information covered on the web-site www.darkswords.eu is official information of Administration and obligatory for execution by each User signed current Agreement.

2.6. People under 18 years old are obliged to coordinate usage of the Game with their representative in law (parents, tutors etc.). Extra chargeable service usage of people under 18 years old is covered in section 5 of the current Agreement.

3.1.1. User has the right to use the Game only in non-commercial purposes in accordance with Game rules.

3.1.2. During the registration User chooses himself login and password which will make possible User identification among other users of the Game. For access to chargeable service the User must inform Administration following personal data: date of birth, e-mail address.

3.1.3. User has the right to change his password. User must provide independently non-disclosure (secret) of his password and other necessary data and accordingly is responsible for keeping and non-disclosure of his password and for all risks (losses) connected with it.

3.1.4. User has no right to pass his registration (login and password) to the third party as well as to accept registration from the third party.

3.1.5. User can send reclamation and proposals connected with the Game in writing or by e-mail address stated on the web-site darkswords.eu.

3.2.1. User has the right to use chargeable service only through authorized representatives of the Administration (Dealers). In case User is informed about illegal actions (not through dealers) he is obliged to inform the Administration immediately.

3.2.2. User has no right to use bugs (software errors) and obliged to inform the Administration about them. User has no right to interrupt software code, get access to game user data base or materials of darkswords.euwithout Administration permission.

3.2.3. User has no right to spread information aimed at illegal access to passwords of "Dark Swords" Game characters as well as to spread links on web-site with similar information.

3.2.4. User is obliged respectively and correctly treat each user of the Game, namely: must not use foul language, must not threaten outside the Game; must not spread in any way materials, propagandizing or showing aversion or hatred to any kind of religion, culture, race, nation, people, language, politics, ideology or social movement; must not advertise porno web-sites, drugs and sources covering similar information and to perform other similar actions.

3.2.5. User has no right to limit access of the other Users to the Game or to hamper other Users from using the Game. User is obliged not to pass any information or software which contains viruses or other harmful components, as well as to perform other actions which contradict Latvian and international law.

3.2.6. User has no right to copy, reproduce, spread and translate into other languages any component of the Game without written permission of the Administration. User accepts and agrees that any material and all necessary software connected to the Game "Dark Swords" are protected by intellectual property laws of Latvian and other international laws. Content provided to the User during usage of the Game "Dark Swords" are protected by author’s rights, trade marks, patents and other laws. User has no right to modify, sell, spread this content, Game materials and software in one piece or in parts. Administration provides User with unexceptional and inexpressible right to use content and materials of the Game and software provided in the Game "Dark Swords" according to rules of the Game if neither User nor other person together with the User is not going to copy or change content and software; create derived software; penetrate the software in order to get software code; sell, give, rent, pass to the third party in any other form of laws in respect of Game material and Game software as well as modify service including illegal access to it.

3.2.7. User is forbidden using exterior software to login into the Game interrupting Game process and others having direct or indirect influence on the Game process. User agrees to play actively and independently. Usage of robots, automatic control systems, provision as well as usage of industrial character development service, character development by mutual winning agreement is forbidden. Presence of two characters at the same time in Game is forbidden.

3.2.8. User agrees that in case violating his responsibilities Administration has right to apply sanctions on him at any time including prohibition of using the Game or using other methods of influence: warning, temporary ban, loss coverage demand and other actions.

4.1. Administration is obliged not to allow spreading the information about the User given during registration to third parties except for cases foreseen by Latvian and international laws; as well as not to change login and password of the User without permission. Administration does not send unjustified e-mails or other messages (spam); in case User received such message from Administration he must inform Administration about it immediately.

4.2. Administration is not responsible for temporary errors and interruptions in connection or other similar failures as well as defects of the computer used for connection to the internet by User.

4.3. Administration is not responsible for losses suffered as a result of using or not using information about the Game by User.

4.4. Administration is obliged to provide accuracy of the software used for receiving information about money transfer.

4.5. Administration is obliged to provide accuracy of the software used for receiving information about money transfer.

4.6. Administration is not responsible in front of the User for actions of other users.

4.7. Administration has right to delete or change any information given by the User on darkswords.eu, web-site without coordination with Administration, or not foreseen with current Agreement as well as other agreements with Administration.

5.1. User has right to use chargeable service of the Game at his choice.

5.2. Chargeable services of the Game can be used by capable Users being over 18 years old. People under 18 years old have right to use chargeable services of the Game in order and under conditions determined by Latvian and international laws.

5.3. Usage of extra (chargeable) service of the Game "Dark Swords" is performed on the basis of current Agreement in the order determined in "Dark Swords" Game rules.

5.4. Chargeable service can be purchased only from people having Administration permission for realization of this service (Dealers). User bears all risks connected with purchasing any service interfering with order and conditions of the current Agreement.

5.5. User is allowed to use chargeable service from the moment of paying for the chargeable service.

5.6. User will not be entitled to any refund of any chargeable service.

5.7. User can request a chargeback if service is not delivered within 5 working days.

6.1. Administration does not guaranty that software of the Game does not have errors and will be functioning without fail.

6.2. Administration is not responsible for losses or any other harm appeared because of the third party actions as well as for actions of the former Administration employees.

6.3. Administration has the right to delete any information or materials from their servers which is unacceptable, unwanted or interfering with the current Agreement.

6.4. Administration has right at any time to limit, enlarge or change quality of service without preliminary informing the User.

6.5. Administration has right at any time to change conditions of the following Agreement. Changes take effect from the moment of publication them on the web-site of the Gamedarkswords.eu, or from the moment determined by the Administration.

6.6. The current Agreement is regulated by Latvian and international laws. Disagreements appeared from the current Agreement are solved by negotiations. In case of impossibility of solving disagreement in extrajudicial order it is transferred to appropriate judicial authority determined according to Latvian legislation if it is not provided by international law.

7.1. Current Agreement takes effect from the moment of agreement expression by the User on the web-site darkswords.eu, by choosing and clicking option “Agree” (or other similar option) by the User. User agrees that his choice of the option means that he previously and in whole volume got familiarized with conditions of the current Agreement and accepts them without any exclusion.

7.2. Agreement is concluded on indefinite period.

7.3. Administration has right to reject current Agreement and to terminate service allotment of using the Game without compensating losses with prior informing the User about Agreement cancellation not less then 5 days before. Information can be given by publication of this information on the web-site darkswords.eu.

7.4. All changed, add-ins, appendixes to the current Agreement or other information are integral parts of it and are obliged for performance from the moment of publication on the web-site darkswords.eu, if other is not determined by the Administration.

7.5. Current Agreement is done in English. The official language of the web-site darkswords.eu is English.

Administration has right to log internet addresses of Users in order to escape spam, flood and other illegal internet actions.
